Creative Arrangements (CA) is a digital music service provided by Partum Nubes AS (Org.nr 929848284), Norway.

These Privacy Policy and Terms of Use apply to all Creative Arrangements services, including creativearts.no, the web-based platform, the iOS app, and integrations such as SpeedAdmin login and license handling.

By accessing or using Creative Arrangements under a valid license agreement, these Terms and this Privacy Policy apply.

Privacy Policy (GDPR)

This Privacy Policy explains how personal data is processed in connection with Creative Arrangements in accordance with the EU General Data Protection Regulation (GDPR).

1. Definitions and Roles

  • Personal Data: Information that can identify a person directly or indirectly.
  • Processing: Any operation performed on personal data (collection, storage, access, deletion, etc.).
  • Data Subject: A teacher or student using the service.
  • Role Allocation: The subscribing school acts as data controller for its users within SpeedAdmin. Partum Nubes AS processes limited technical data necessary to deliver Creative Arrangements in accordance with applicable data protection regulations.

2. Categories of Data Processed

Creative Arrangements processes only data necessary to deliver the service:

  • User authentication data via SpeedAdmin (user ID, school affiliation) as provided through the SpeedAdmin integration.
  • Technical usage data (session activity, playback events, feature interaction)
  • Technical logs (browser, session time, error codes)

Creative Arrangements does not independently collect student names, contact details, grades, or educational records. User authentication and core account management are handled via SpeedAdmin.

3. How Data Is Collected

  • Indirectly via SpeedAdmin authentication
  • Automatically through use of the platform (sessions, playback, interactions)

4. Purpose of Processing

Data is processed for:

  • Delivering and maintaining platform functionality
  • Ensuring service stability and security
  • Generating anonymised usage statistics for royalty reporting
  • Improving usability and performance

Personal data is not used for advertising, profiling, behavioural tracking, or marketing purposes.

5. Data Retention

  • Usage data is retained during the active school term covered by the license agreement.
  • Aggregated anonymised statistics may be retained for royalty documentation.
  • Technical logs are retained for a maximum of 6 months.

    • All data is stored within the EU/EEA.

6. Legal Basis

Processing is based on:

  • Contract with the subscribing school (Art. 6(1)(b) GDPR)
  • Legitimate interest in ensuring service stability and security (Art. 6(1)(f) GDPR)

7. Data Sharing

Data may be shared only with:

  • SpeedAdmin (authentication and license administration)
  • Subcontractors under signed Data Processing Agreements
  • Public authorities where required by law

Creative Arrangements does not sell personal data or share it for commercial marketing purposes.

8. Data Subject Rights

Data subjects may request:

  • Access to personal data
  • Correction or deletion
  • Restriction or objection to processing

Requests may be directed to the subscribing school or to:

Data subjects may also lodge a complaint with their national data protection authority.

9. Security Measures

Partum Nubes AS implements appropriate technical and organisational measures, including:

  • Encrypted data transmission
  • Access controls and authentication safeguards
  • Data processing agreements with all processors

10. Cookies

Creative Arrangements uses essential session cookies necessary for:

  • Authentication
  • License validation
  • Core platform functionality

No marketing or profiling cookies are used within Creative Arrangements.

Terms of Use

These Terms apply to schools subscribing to Creative Arrangements and to teachers and students using the service.

1. General

By using Creative Arrangements under a valid license agreement, you agree to these Terms.

3. Users and Access

Only schools may purchase a license.
An iOS app may be available for authorized users.
Licenses are non-transferable.

4. License Scope and Duration

The license runs per school term.
Renewal and billing are handled via SpeedAdmin in accordance with the agreement between the school and SpeedAdmin.
Creative Arrangements is licensed for educational, non-commercial use within the subscribing institution.

5. Content and Copyright

All content within Creative Arrangements is owned by or properly licensed to Partum Nubes AS.

Creative Arrangements may include arrangements based on copyrighted works.

Where applicable, usage and print rights are handled in accordance with relevant licensing agreements and national copyright regulations.

Nothing in these Terms transfers intellectual property rights to the user.

6. Permitted Use

Users may:

  • Access digital arrangements within the platform
  • Use materials for educational purposes within the licensed institution
  • Print sheet music where permitted under applicable copyright regulations and licensing agreements

7. Prohibited Use

Users may not:

  • Share login credentials
  • Redistribute materials outside the licensed institution
  • Modify or reverse engineer the platform
  • Use materials for commercial purposes
  • Attempt unauthorized access to the system

8. Data Protection

Personal data processing is governed by the Privacy Policy and the integration with SpeedAdmin.

9. Technical Requirements

Internet access is required for login and full functionality.

Creative Arrangements works best in Chrome, Edge, and Firefox. Safari is not fully supported.

10. Updates

Partum Nubes AS may update the service or these Terms.

Material changes will be communicated to licensed schools.

11. Termination

Termination must be submitted in writing prior to the start of the next school term.
Access may be suspended or terminated in cases of serious breach of these Terms.
Partum Nubes AS reserves the right to claim compensation for documented damages resulting from breaches.

12. Liability and Limitations

Partum Nubes AS undertakes reasonable efforts to ensure the availability and stability of the Service. However, we are not liable for interruptions, delays, or failures caused by circumstances beyond our reasonable control, including but not limited to:

  • Failures of external networks or internet service providers
  • Downtime or technical issues related to third-party hosting providers or cloud infrastructure
  • Errors or interruptions caused by third-party services (including authentication, payment, or integration partners)
  • Force majeure events
  • User equipment, software, or connectivity issues

To the extent permitted by applicable law, Partum Nubes AS shall not be liable for indirect, incidental, or consequential damages, including loss of data, revenue, or business opportunities.
